Justiça valida testamento deixado por Gugu Liberato; Rose Miriam não terá direito a herança
O testamento deixado pelo apresentador Gugu Liberato, que morreu em novembro de 2019, foi validado pela 3ª Turma do Superior Tribunal de Justiça (STJ) nesta terça-feira, 20. O documento foi assinado em 2011 e estabelece que a maior parte da herança (75%) do comunicador, calculada em R$1 bilhão, deveria ficar com os seus filhos e o restante (25%) com os seus sobrinhos. Rose Miriam di Matteo, ex-companheira do jornalista, ficou de fora da partilha do montante.
O entendimento do colegiado, que teve a ministra Nancy Andrighi como relatora, aponta que o apresentador pretendia desfrutar de todo o seu patrimônio, e não de uma determinada parcela — esta intenção, segundo o tribunal, foi apresentada por Gugu como o seu último ato de vontade.
Por meio de nota, Nelson Wilians, advogado que representa as filhas do apresentador no processo, afirma que vai recorrer da decisão exposta pela 3ª Turma do STJ.
“Os ministros decidiram reverter a correta decisão do Tribunal de Justiça de São Paulo que havia reduzido a disposição testamentária, a fim de que o testamento deixado pelo apresentador Gugu Liberato respeitasse o disposto em Lei e na jurisprudência do próprio STJ. No testamento, ele dispôs de 100% da totalidade de seus bens, sem respeitar a parte legítima dos filhos”, pontuou o advogado em nota.
As filhas de Gugu defendem que a sua mãe, Rose Miriam, tenha acesso a uma parte da herança. A ex-companheira do apresentador busca reconhecimento de relação estável para ter direito a metade do dinheiro deixado — caso este quadro seja concretizado, os outros 50% do montante ficariam com os três filhos. Por outro lado, o filho do comunicador dá lastro ao entendimento deixado no testamento.
