Oficial de Justiça publica vídeo zombando de religiões de matriz africana: ‘Macumba mandada pelo SUS’
Caso aconteceu na praia do Preá, no município de Cruz, na região norte do Ceará.
Um oficial de Justiça do Ceará publicou no sábado (19) um vídeo em que aparece zombando de uma cerimônia de religião de matriz africana que ocorria no município de Cruz, na região norte do estado. O vídeo repercutiu nas redes sociais, com críticas às falas do oficial.
“Faz o L, negrada. Já chegou aqui na Praia do Preá um terreiro de macumba mandado pelo SUS, viu? Olha aí, faz o L, tá chegando aí”, diz João Ivan Sobrinho Dutra, que atua como oficial de justiça na comarca da cidade de Bela Cruz, vizinha ao município de Cruz, destino turístico onde a cena foi gravada.
Ivan faz uma referência à resolução do Conselho Nacional de Saúde (CNS) que recomendou ao Ministério da Saúde reconhecer terreiros e barracões de umbanda e candomblé como equipamentos que promovem práticas complementares de saúde.
Desde a publicação da recomendação do CNS, opositores do governo Lula têm afirmado que o Sistema Único de Saúde (SUS) vai incluir umbanda e candomblé como formas de tratamento médico – o que não é verdade.
Já o termo “faz o L” tem sido utilizado por apoiadores do presidente Luís Inácio Lula da Silva para destacar realizações positivas do governo, e por opositores do petista para criticar as adversidades.
Em um comentário no Instagram, Ivan afirmou que não teve intenção de cometer um ato de intolerância religiosa e que o vídeo era uma “brincadeira”.
“Só fiz uma brincadeira com amigos totalmente sem maldade, sem falar que eu respeito todas as religiões, por favor não me interpretem mal”, escreveu.
Tribunal de Justiça requer ‘neutralidade’ dos servidores
Como oficial de justiça, Ivan Dutra é funcionário do Tribunal de Justiça do Ceará (TJ-CE), órgão máximo do Poder Judiciário cearense.
Em nota, o TJ afirmou que “repudia todo e qualquer ato de intolerância religiosa, preconceito ou discriminação que atentem contra a liberdade de crença ou livre exercício de cultos religiosos”.
O tribunal também destacou que “o Código de Ética dos Servidores do Poder Judiciário do Estado do Ceará impõe, como dever expresso, o de manter neutralidade em face de influências religiosas, de modo a evitar que venham a afetar a imparcialidade de suas responsabilidades profissionais”.
Por fim, o TJ afirmou que adotará providências de caráter disciplinar para apurar a conduta do servidor.
A Polícia Civil do Ceará (PC-CE) informou que apura “uma possível ocorrência de intolerância religiosa” e ressaltou que as vítimas devem realizar o Boletim de Ocorrência (BO) para auxiliar na investigação.
Resolução do CNS é apenas recomendação
A resolução 715 de 2023 do Conselho Nacional de Saúde, publicada no dia 20 de julho, tem causado polêmica nas redes sociais desde que opositores do governo Lula afirmam que a medida iria estabelecer o candomblé e a umbanda como formas de tratamento no SUS.
O CNS é um órgão que tem como objetivo monitorar as políticas sanitárias executadas pelo Ministério da Saúde e recomendar mudanças e melhorias. Seus membros são eleitos e conselho é composto por usuários do SUS, representantes do governo e profissionais da saúde.
As resoluções do CNS não têm poder para instituir novos tratamentos. Os textos trazem apenas recomendações para o Ministério da Saúde, que pode acatar ou não a sugestão.
No ponto 46 da resolução 715, o CNS recomenda que o ministério reconheça “manifestações da cultura popular dos povos tradicionais de matriz africana e as Unidades Territoriais Tradicionais de Matriz Africana (terreiros, terreiras, barracões, casas de religião, etc.) como equipamentos promotores de saúde e cura complementares do SUS”.
A recomendação não substituiria tratamentos médicos por práticas religiosas, mas acrescentaria estas práticas no rol de recursos terapêuticos que têm como objetivo a prevenção de doenças e criação de um vínculo terapêutico com o paciente.
Se o ponto 46 da resolução 715 for acatado pelo Ministério da Saúde, práticas de matriz africana, como umbanda e candomblé, seriam incorporadas à Política Nacional de Práticas Integrativas e Complementares do SUS, onde já constam terapias como yoga, homeopatia, meditação, biodança, ozonioterapia, entre outros.
