PDT de Ciro Gomes é autor de pedido que pode tirar Bolsonaro do jogo político
O ex-presidente Jair Bolsonaro (PL) pode perder os direitos políticos e ficar inelegível por oito anos caso seja condenado pelo Tribunal Superior Eleitoral (TSE) nesta quinta-feira, 22, em razão de uma ajuizada pelo PDT, do ex-candidato a presidente Ciro Gomes.
A Corte vai decidir se o ex-mandatário usou o cargo e a estrutura do governo para espalhar notícias falsas sobre o processo eleitoral e para fazer campanha em reunião com embaixadores estrangeiros em julho de 2022, enquanto ainda era presidente.
O PDT sustenta que Bolsonaro espalhou um “arsenal de inverdades” com o objetivo de se beneficiar eleitoralmente durante o encontro. A ação cita três motivos para a condenação do ex-presidente: abuso de poder político, abuso de poder no uso dos meios de comunicação e conduta vedada aos agentes públicos em campanhas eleitorais.
Segundo o advogado Walber de Moura Agra, um dos autores da ação, as declarações do então presidente na reunião com os embaixadores não consistem em um episódio isolado. Para ele, Bolsonaro manteve uma conduta reiterada de descredibilização do sistema eleitoral durante o período na Presidência da República.
“Ficou claro que houve utilização da TV Brasil, a pressão em funcionários públicos, a disseminação de desordem informacional e utilização de patrimônio público. Além da reunião, uma série de eventos corroboram tudo o que o processo está dizendo. Era algo sistemático, estrutural e reiterado para minar as instituições e a democracia”, disse Agra ao Estadão.
Julgamento no TSE: acusações do PDT contra Bolsonaro
O partido lista onze afirmações e ataques à Justiça Eleitoral e ao sistema eletrônico de votação do ex-presidente durante a reunião que configuram, segundo a ação, discurso eleitoral:
– As urnas completaram automaticamente o voto no PT na eleição de 2018
– As urnas brasileiras não possuem sistemas que permitem auditoria
– Não é possível acompanhar a apuração dos votos
– O inquérito que investiga uma invasão ao sistema do TSE, em 2018, não estava sob sigilo
– A apuração dos votos é realizada por uma empresa terceirizada
– O TSE não aceitou sugestões das Forças Armadas para melhorar a segurança do processo eleitoral
– O TSE divulgou que os resultados de 2018 podem ter sido alterados
– As urnas eletrônicas sem impressão do voto são usadas apenas em dois países além do Brasil
– Os observadores internacionais não têm o que fazer no Brasil porque a contagem de votos não é pública
– Um hacker teve acesso a sistemas do TSE, inclusive a milhares de códigos-fontes e a uma senha de um ministro do TSE
– A Polícia Federal pediu os registros cronológicos de acesso ao sistema computacional do TSE, mas sete meses depois a Corte asseverou que eles foram apagados
Aos embaixadores, Bolsonaro alegou que tudo o que foi apresentado estava documentado. Porém, ele apresentou apenas um compilado de declarações de ministros e trechos fora do contexto da apuração da PF. “O que eu mais quero por ocasião das eleições é a transparência. Queremos que o ganhador das eleições seja aquele que foi votado”, disse Bolsonaro.
Os advogados de Bolsonaro afirmam que o evento constou de agenda oficial do então presidente da República, previamente informada ao público, e que a má-fé de determinados setores da imprensa levou a cobertura da reunião a tratar “uma proposta de aprimoramento do processo democrático como se se tratasse de ataque direto à democracia”. Segundo a defesa, o evento, na verdade, foi “um convite ao diálogo público continuado para o aprimoramento permanente e progressivo do sistema eleitoral e das instituições republicanas”.
A legislação eleitoral proíbe o uso da máquina pública e da estrutura do governo em benefício dos candidatos que buscam a reeleição. O abuso de poder político ocorre justamente quando um candidato usa o cargo para tentar influenciar indevidamente a preferência dos eleitores.
“O senhor Jair Messias Bolsonaro, valendo-se de sua condição funcional realizou reunião com os embaixadores de países estrangeiros residentes no Brasil para falar sobre as eleições deste ano, especificamente para atacar a integridade do processo eleitoral com fake news”, diz o PDT.
A reunião de Bolsonaro com os embaixadores foi amplamente divulgada à época, inclusive pelos meios de comunicação oficiais do governo federal. O encontro foi transmitido pela TV Brasil e disponibilizado no site da estatal.
O PDT argumenta que o então presidente cometeu abuso de poder no uso indevido dos veículos de comunicação ao promover “um desequilíbrio de forças decorrente da exposição massiva de um candidato nos meios de comunicação em detrimento de outros, de modo apto a comprometer a normalidade e a legitimidade do pleito”.
Julgamento Bolsonaro: Inclusão de minuta golpista
Durante o processo, o PDT pediu ainda a inclusão da minuta golpista apreendida pela Polícia Federal na casa do ex-ministro da Justiça Anderson Torres, que foi preso na investigação sobre os atos de vandalismo na Praça dos Três Poderes, em Brasília. O rascunho previa uma intervenção no TSE, liderada por Bolsonaro com apoio do Ministério da Defesa, para anular o resultado da eleição.
“Não significa uma modificação do processo. Não se está colocando um fato novo. A minuta do golpe não é uma tese, é um documento. Não é apócrifo. Consiste em uma prova e o próprio tribunal entendeu desta forma”, explicou Agra, advogado do PDT.
